Welcome to Cove. By accessing or using our website and services, you agree to be bound by these Terms of Service. Please read them carefully before using our platform.

Acceptance of Terms

By creating an account, making a booking, or otherwise using Cove's services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree to these terms, please do not use our services. We reserve the right to modify these terms at any time, and your continued use of the platform constitutes acceptance of any changes.

Description of Service

Cove is a booking platform that connects customers with water activity operators in Malta. We facilitate the discovery and booking of experiences including boat tours, diving excursions, snorkeling trips, and other water-based activities.

Cove acts as an intermediary between customers and operators. We do not own, operate, or directly provide the water activities listed on our platform. The operators are independent businesses responsible for delivering their services.

Booking and Payments

When you book an experience through Cove, you agree to pay the deposit amount specified at the time of booking. The remaining balance is typically paid directly to the operator on the day of your experience.

  • All prices are displayed in Euros (EUR)
  • Deposits are processed securely through Stripe, our payment processor
  • You must provide accurate payment and contact information
  • Bookings are confirmed once the deposit payment is successfully processed

Booking Completion

Bookings are automatically marked as completed the day after your scheduled activity. If there was an issue with your experience that you wish to report, please contact us within 48 hours at hello@covemalta.com.

Payment Processing

All payments on Cove are processed by Stripe, a PCI-DSS Level 1 certified payment processor. By using our payment services, you also agree to Stripe's Terms of Service.

Important information about payment data:

  • Your full card details are transmitted directly to Stripe and are never stored on Cove's servers
  • Cove only receives a secure token and the last four digits of your card for reference
  • All payment data is encrypted in transit using TLS (HTTPS)

Cancellation Policy

Cancellation policies may vary by operator and experience. The specific cancellation terms will be displayed before you complete your booking. Generally:

  • Cancellations made 24+ hours before the scheduled time are eligible for a full deposit refund
  • Cancellations made within 24 hours may forfeit the deposit
  • Weather-related cancellations by operators entitle you to a full refund or rescheduling
  • No-shows without prior notice forfeit the entire deposit

Refunds

When a refund is approved under our cancellation policy:

  • Refunds are issued to the original payment method used for the booking
  • Processing typically takes 5-10 business days, depending on your bank or card issuer
  • You will receive an email confirmation when the refund is initiated
  • If you do not see the refund after 10 business days, please contact your bank first, then reach out to us

User Responsibilities

When using Cove, you agree to:

  • Provide accurate and complete information
  • Be at least 18 years old or have parental consent
  • Follow all safety instructions provided by operators
  • Disclose any relevant health conditions that may affect your participation
  • Arrive on time for your scheduled experience
  • Treat operators and their equipment with respect

User Reviews

After completing an activity, you may be invited to submit a review. When you submit a review:

  • Reviews are subject to moderation before publication to ensure quality and appropriateness
  • We may reject reviews containing inappropriate content, spam, personal attacks, or demonstrably false claims
  • Approved reviews are publicly visible on the activity listing page
  • You retain ownership of your review content but grant Cove a non-exclusive, royalty-free license to display, reproduce, and distribute your review on our platform
  • You may request removal of your review by contacting us at hello@covemalta.com

Account Termination

Your right to close your account: You may close your Cove account at any time by contacting us at hello@covemalta.com. Upon closure, we will retain data only as required by law or as described in our Privacy Policy.

Our right to suspend or terminate: We reserve the right to suspend or terminate your account if you:

  • Violate these Terms of Service
  • Provide false or misleading information
  • Engage in fraudulent activity or payment disputes in bad faith
  • Harass operators, staff, or other users
  • Misuse the platform in any way that harms Cove or its community

We will provide notice before termination where reasonably possible, except in cases of serious violations.

Limitation of Liability

Cove facilitates bookings but is not responsible for the actual delivery of water activities. To the fullest extent permitted by law:

  • Cove is not liable for any injury, loss, or damage arising from participation in water activities
  • Operators are solely responsible for safety, insurance, and service quality
  • We make no warranties about the availability or quality of listed experiences
  • Our liability is limited to the amount of any deposits paid through our platform

Water activities carry inherent risks. You acknowledge these risks and participate at your own discretion.

Dispute Resolution

If you have a dispute or complaint, we encourage you to resolve it directly with us before taking formal action:

Step 1: Contact Us

Email us at hello@covemalta.com with details of your concern. We aim to respond within 2 business days and resolve most issues within 14 days.

Step 2: Escalation

If you are not satisfied with our initial response, you may request escalation to our management team by replying to the original email thread or writing to privacy@covemalta.com.

Step 3: Formal Proceedings

If the dispute cannot be resolved through the above steps, it shall be subject to the exclusive jurisdiction of the courts of Malta. For information about how we handle your data during disputes, see our Privacy Policy.

Intellectual Property

All content on Cove, including text, graphics, logos, and software, is the property of Cove or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

Governing Law

These Terms of Service are governed by the laws of Malta. Any disputes arising from your use of Cove shall be subject to the exclusive jurisdiction of the courts of Malta.

Changes to Terms

We may update these Terms of Service from time to time. We will notify you of significant changes by posting a notice on our website or sending you an email. Your continued use of Cove after changes are posted constitutes acceptance of the modified terms.
